How Legal Fees Are Calculated in Malaysia
Legal fees for property transactions in Malaysia are regulated by the Solicitors' Remuneration Order 2023 (SRO 2023), Table A. Lawyers cannot charge more than the prescribed scale — and most charge exactly the scale amount. The fees are calculated on two separate documents: the Sale and Purchase Agreement (SPA) and the Loan/Financing Agreement.
SPA Legal Fees
The SPA fee is based on the property purchase price. For a RM500,000 property: 1.25% × RM500,000 = RM6,250. For a RM1,000,000 property: 1.25% × RM500,000 + 1.0% × RM500,000 = RM11,250. Plus 6% SST on the fee and disbursements (land search, registration, postage — typically RM500–1,500).
Loan Agreement Legal Fees
The loan agreement fee uses the same Table A scale but is calculated on the loan amount, not the property price. With 90% financing on a RM500,000 property, the loan amount is RM450,000, so: 1.25% × RM450,000 = RM5,625. If your loan is RM700,000: 1.25% × RM500,000 + 1.0% × RM200,000 = RM8,250.
Who Pays What?
The buyer pays all legal fees in a standard property transaction — both SPA and loan agreement fees. In a subsale transaction, the seller pays their own lawyer for the discharge of their existing loan (typically RM1,000–2,500). For a detailed walkthrough, see our Legal Fees Guide.

Can You Negotiate Legal Fees?
The SRO 2023 sets the scale, but it is not entirely rigid. Paragraph 6(1) permits a solicitor to give a discount of up to 25% on Table A of the First Schedule (sale and transfer) and Table A of the Third Schedule (charge and financing documents) — so on a sub-sale purchase, asking for a discount is legitimate and within the Order. Paragraph 6(2) permits no discount on Table B, which governs Housing Development Act transactions where you buy directly from a developer, nor on the Second, Fourth, Fifth or Sixth Schedules. Are legal fees and stamp duty the same thing?
No. Legal fees are paid to your conveyancing lawyer for preparing and executing the SPA, loan agreement, and property transfer documents. Stamp duty is a government tax collected by LHDN on the MOT (1-4% for citizens, 8% for foreigners on residential) and loan agreement (0.5%). Both are payable when buying property, but they go to different parties.
Can I negotiate legal fees when buying property in Malaysia?
Partly. Paragraph 6(1) of the Solicitors' Remuneration Order 2023 allows a solicitor to give a discount of up to 25% on the fees in Table A of the First Schedule (sale and transfer) and Table A of the Third Schedule (charge and financing documents).
